1. Scope

This Legal Notice and these Terms of Use govern the use of the online platforms of SwissOps Sàrl (hereinafter "SwissOps.ch") and its partners, as well as all of its services. The use of services and third-party websites affiliated with the online platforms of SwissOps.ch may be subject to the terms of the partner concerned. By using the SwissOps.ch website, the user (hereinafter "the user" or "you") accepts this Legal Notice and these Terms of Use.

2. Services of SwissOps.ch

2.1. General

SwissOps.ch offers the user a whole range of services free of charge on its online platform (including on its iOS and Android mobile applications, where available). The content and form of these services may be modified, extended or suspended at any time. SwissOps.ch also offers paid services through its online platforms and may, at any time, rely on third parties to deliver them.

2.2. Registration data

Some services may require the user to register. During registration, SwissOps Sàrl stores the user's personal data (see Privacy, Data protection). The user is required to provide the requested information correctly and in full, and to update it without delay where necessary. The user is therefore solely responsible for the content of their registration and for the personal information they provide. SwissOps.ch takes measures to prevent fraudulent interventions by third parties. However, SwissOps.ch cannot be held liable for the consequences of unauthorised interventions. Finally, SwissOps.ch has the right to delete a user's registration at any time, without justification.

2.3 Storage and publication of submitted content

Each submission of content constitutes a use by which the user accepts the Terms of Use of SwissOps.ch in force. The user expressly agrees to the publication of their content. Nevertheless, SwissOps.ch is under no obligation to publish content online and is also free to remove it from its website at any time, likewise without justification. Any comments or reviews published on the SwissOps.ch website are the subjective view of their author and not the opinion of SwissOps.ch. Their publication implies neither the approval nor the agreement of SwissOps.ch. The user may nevertheless report possible abuse through the online contact form.

2.4 Limitation of liability

To the fullest extent permitted by law, SwissOps Sàrl, its officers, employees, partners and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to the Services offered, including:

• Loss of profits, revenue or business opportunities
• Loss of data or information
• Service interruptions or technical problems
• Failure to achieve the expected results
• Any other damage or commercial loss

3. Obligations of the user

The user undertakes to refrain from any unlawful action and to use the available services in accordance with the Terms of Use and this Legal Notice of SwissOps.ch. It is, for example, strictly forbidden to introduce data containing a computer virus into the system or to hinder, in any way, the accessibility of the services for other users. The user acknowledges that the content and information (addresses, URLs, logos, etc.) offered on the SwissOps.ch website are protected by third-party rights legislation. The user undertakes to handle their access data (username, password) knowingly, confidentially and with care. SwissOps.ch cannot be held responsible for misuse of access data or for damage resulting from non-compliant or fraudulent access. If the user notices unlawful offers or other abuse on SwissOps.ch, they must immediately inform the SwissOps.ch team through the online contact form. The user undertakes to respect netiquette and not to infringe the Swiss legislation in force with the content they publish. They shall take care not to publish content that is racist, threatening, inciting violence, pornographic, obscene, or that infringes personality rights, competition law or honour, and shall respect third-party copyright. SwissOps.ch has the right to block, delete or refuse to publish content that breaks these rules, without delay or warning. In such a case, SwissOps.ch has the right to prohibit the user from submitting further content.

4. Updating of data

SwissOps.ch strives to use current and correct data. The user nevertheless acknowledges that this data may contain errors or incomplete information. SwissOps.ch declines all responsibility for errors or their consequences. Errors may, however, be reported through the online contact form.

5. Copyright, intellectual property and liability

Copyright protects all content available on the SwissOps.ch website (all rights reserved). The user receives the non-transferable and non-exclusive right to use the services offered by SwissOps.ch. All pre-existing or newly arising intellectual property rights concerning the services remain with SwissOps.ch or its partners. Downloading or printing online content published on the SwissOps.ch website is only permitted for personal, non-commercial use and provided that copyright notices and other legally protected designations remain visible at all times. The reproduction, transmission (electronic or by other means), modification or linking, in whole or in part, of the online pages of SwissOps.ch for public or commercial purposes is strictly prohibited without the prior written consent of SwissOps.ch. Finally, SwissOps.ch is not responsible for content published by other users on its web pages, nor for the content of other online websites, even affiliated ones. 6. Availability

SwissOps.ch strives to guarantee the accessibility and availability of its online platforms. Nevertheless, operation of the services without temporary interruption or failure cannot be guaranteed. Within the limits of the law, any liability of SwissOps.ch towards the user or third parties is excluded.

7. Languages of the Legal Notice and Terms of Use

This Legal Notice and these Terms of Use are drawn up in French. The French version, being the original, prevails in the event of any contradiction with other translations, including this English translation, which is provided for convenience only.

8. Final provisions

SwissOps.ch evolves over time and may therefore modify this Legal Notice and these Terms of Use at any time. Unless stated otherwise, any modifications apply as soon as they are published on the online platforms of SwissOps.ch. In the event of non-compliance with the Legal Notice or Terms of Use, a user may be denied access to the online services of SwissOps.ch. Should one or more provisions prove to be null or void, the validity of the remaining provisions shall not be affected. Swiss law applies. The place of jurisdiction is the registered office of the company (Renens).
